Ratio Decidendi

The court found that the application was procedural, aimed at facilitating the implementation of its prior judgment and decree requiring the defendants to vacate the suit premises. There was no stay of execution in force, and the defendants remained in occupation in defiance of the decree. The court determined that it was unnecessary to hear the application inter partes, as the orders sought were to give effect to the existing judgment. Accordingly, the court granted the issuance of eviction warrants to the appointed auctioneer and directed the officer commanding Ntumu Police Station to provide security and maintain peace during the execution. Costs were awarded to the applicants.
