Ratio Decidendi

The court found that although the application was not initially directed against the interested parties, the applicant served them with the application, resulting in their participation in the proceedings. The interested parties filed replying affidavits and were recognized by the court as proper parties to the matter. Applying the principle that costs follow the event, the court held that the applicant, having caused the interested parties to incur costs by serving them and prompting their participation, should bear their costs upon withdrawal of the application. The court thus ordered that the applicant pay the costs of the interested parties.
