Procedural Posture

Judicial Review / Judgment

  1. 1 Whether an order of mandamus should issue to compel the respondents to pay the decretal sum awarded in Nakuru CMCC No. 1997 of 1999.
  2. 2 Whether the Attorney General is under a statutory duty to satisfy the judgment and certificate of costs served upon him.

Ratio Decidendi

The court found that the applicant had obtained a judgment and certificate of costs against the government, served the Attorney General as required, and that the Attorney General had failed to pay the decretal sum without lawful justification. Under section 21 of the Government Proceedings Act, the Accounting Officer is under a statutory duty to satisfy such judgments. Since execution against the government is prohibited, the appropriate remedy is an order of mandamus to compel payment. The application was unopposed, and the court was satisfied that all statutory requirements had been met. Therefore, the applicant was entitled to the order of mandamus as prayed.

Court Disposition

Application allowed. Orders of mandamus granted as prayed.

Orders

  • An order of mandamus is issued compelling the respondents to pay Kshs. 433,675 plus interest at court rates from the date of filing suit until payment in full, being the decretal sum inclusive of costs in Nakuru CMCC No. 1997 of 1999.
  • Costs of the application are awarded to the applicant.
