The Tribunal found that the respondents did not fully comply with the statutory requirements for exercising the power of sale over the claimant's charged property. The statutory notice issued under Section 90 of the Land Act was internally inconsistent regarding the compliance period and failed to inform the claimant of his right to seek relief from the court. The respondents also failed to issue a proper notice to sell under Section 96(2) of the Land Act, and the redemption notice issued by the auctioneer was inconsistent with the statutory notice, contravening Rule 15(d) of the Auctioneers Rules.
