Ratio Decidendi

The court found that the plaintiffs had occupied and possessed the suit land openly, continuously, and without interruption for over 45 years. The defendant, though the registered proprietor, had never asserted any rights, developed, or appeared on the land. The plaintiffs' evidence was unchallenged and credible. Under section 38 of the Limitation of Actions Act, such possession extinguishes the rights of the registered proprietor after 12 years. The court was satisfied that the plaintiffs had acquired title to the land by adverse possession and that the defendant's title was extinguished.
