Ratio Decidendi

The court found that it retains jurisdiction to hear an application for stay of execution even after a notice of appeal has been lodged, by virtue of Order 42 Rule 6 of the Civil Procedure Rules. The applicant demonstrated that the application was filed timeously, that there is a risk the appeal would be rendered nugatory if stay is not granted, and expressed willingness to provide security. The court was satisfied that the applicant met the legal threshold for stay of execution. However, the stay was made conditional upon the decretal sum being deposited in an interest-earning account in the joint names of the parties' advocates within 60 days, failing which execution would proceed.
