Despite evidence of absenteeism and disciplinary issues, the timing of the termination—shortly before the claimant's expected maternity leave—and the absence of a disciplinary hearing rendered the process unfair. The respondent did not provide evidence that the claimant was invited to a hearing or given an opportunity to defend herself. As such, the termination was procedurally and substantively unfair under the Employment Act.
