Ratio Decidendi

The court found that the Claimant was employed on a series of fixed term contracts, the last of which expired on 31st January 2016. There was no evidence of unfair termination as the Claimant was paid for all days worked and her absence after 17th January 2016 was not due to any action by the Respondent. The court held that expiry of a fixed term contract, without renewal, does not constitute unfair termination. However, the Claimant was entitled to pay in lieu of annual leave for the entire period worked, as the Respondent did not provide annual leave to contract employees, contrary to statutory requirements. The court awarded the Claimant pay in lieu of annual leave and limited costs.
