Ratio Decidendi

The court found that while the application for stay of execution was filed without unreasonable delay, the appellant failed to establish that she would suffer substantial loss if the order for stay was denied. Execution is a lawful process and does not, in itself, constitute substantial loss. As the second principle under Order 42 rule 6 was not satisfied, the court declined to consider the requirement for security for due performance. Consequently, the motion for stay of execution was dismissed for lack of merit.
