Ratio Decidendi

The court held that a suit filed in a court without jurisdiction is fundamentally defective and a nullity in law. Such a suit cannot be transferred to another court, regardless of the applicant's reasons or advice received from the court registry. The Machakos Chief Magistrate’s Court must first address the preliminary objections regarding its jurisdiction. Allowing the transfer would subvert the rule of law and circumvent proper procedure. The application was therefore found to be an abuse of court process and dismissed with costs to the respondent.
