Ratio Decidendi

The court found that the affidavit in support of the application was incomplete because none of the attached exhibits were commissioned in accordance with the Oaths and Statutory Declarations Act. This non-compliance rendered the affidavit defective and unreliable. Since the application was supported solely by this defective affidavit, the entire application was deemed irregular and could not be sustained. Consequently, the application to strike out the appeal was itself struck out with costs awarded to the respondent.
