Ratio Decidendi

The court found that the issue of limitation, as raised in the preliminary objection, could not be determined at this stage because the petitioner's claim related to a continuing injury rather than a single event. Section 90 of the Employment Act contemplates continuing injury, and thus the limitation issue requires full determination of the petition. Regarding exhaustion, the court held that Section 77 of the County Government Act only applies where a decision has been made by the County Public Service Board. In this case, the board was accused of inaction, and therefore there was no decision to appeal to the Public Service Commission. As such, the doctrine of exhaustion did not apply....
