Procedural Posture

Civil Application / Ruling on Application to Restore Dismissed Application for Extension of Time

  1. 1 Whether the applicant's new advocates had proper locus standi to file the restoration application after a change of advocates post-judgment.
  2. 2 Whether the application for restoration of the dismissed application for extension of time should be allowed.

Ratio Decidendi

The court held that the applicant's new advocates had complied with the requirements for change of advocates under Order III rule 9A of the Civil Procedure Code, as leave had been granted by consent of the parties. The absence of a specific provision in the Court of Appeal Rules as to when a change of advocate becomes effective does not invalidate the authority of the new advocates to act. Therefore, the objection to the locus standi of the applicant's new advocates was dismissed. As there were no other grounds of opposition, the application for restoration of the dismissed application for extension of time was allowed.
