Ratio Decidendi

The court found that the parties had not cohabited or consummated their marriage since its celebration on 13th June 2008. The evidence presented by the Petitioner was unchallenged, as the Respondent neither appeared nor filed a response. The court applied section 73(1)(a) of the Marriage Act, which allows annulment where a marriage has not been consummated. The court was satisfied that the statutory requirements for annulment were met and that there was no evidence of collusion or condonation. Accordingly, the court granted the annulment as prayed.
