Civil Suit / Ruling on Application and Final Judgment on Admission

  1. 1 Whether the suit property registered in the 1st Defendant's name is matrimonial property jointly owned by the Plaintiff and the 1st Defendant.
  2. 2 Whether the Plaintiff is entitled to a declaration of joint ownership and division of the suit property in equal shares.
  3. 3 Whether judgment can be entered on admission by the 1st Defendant.

Ratio Decidendi

The court found that the 1st Defendant had unequivocally admitted both in his pleadings and affidavit that the suit property is matrimonial property and that the Plaintiff is entitled to half a share. There being no dispute on the facts and no defence filed, the court determined that it was appropriate to enter judgment on admission under Order 13 Rule 1 of the Civil Procedure Rules. The court declared the property to be jointly owned in equal shares and ordered its division accordingly. The application for interlocutory injunction was rendered moot by the final determination of the substantive issue.

Court Disposition

Judgment entered for the Plaintiff on admission; declaration of joint ownership and order for division of property.
