Ratio Decidendi

The court found that consolidation is only appropriate where the suits share the same parties, subject matter, and legal/factual issues. Upon review, the court determined that ELC 770 of 2017 and ELC 53 of 2018 concern the same properties and legal questions, and none of the parties in ELC 53 of 2018 objected to consolidation. However, ELC 144 of 2018 involves different properties (L.R Ndeiya/Ndiuni/T.983 and T.984), different facts, and different remedies, with only a tangential mention of the properties in dispute in the present suit. Consolidating ELC 144 of 2018 would unnecessarily involve parties with no interest in those properties and would prejudice the plaintiff in that suit....
