The court found that the suit properties, as described by the plaintiffs, no longer exist because they were consolidated into a new parcel (Plot No. 15870) and subsequently subdivided into 278 independent plots with new titles. Since adverse possession can only be claimed against an existing title, and the remedy would be registration as proprietor of that title, the plaintiffs' claim was fundamentally defective. The court held that it is not possible to grant title to a non-existent parcel, rendering the suit an abuse of the court process and disclosing no reasonable cause of action.
