The court held that since Mr. Collins Odhiambo Ario did not possess a valid practising certificate at the time of filing the plaint, he was not entitled or authorized to act as an advocate or file the suit on behalf of the plaintiff. Section 9 of the Advocates Act, Cap 16, was clear that only advocates with a valid practising certificate may act as such. The Law Society of Kenya confirmed Mr. Ario's lack of certification, and this was not contradicted by the plaintiff or Mr. Ario. Following the Court of Appeal's decision in Obura v Koome, pleadings filed by an unqualified person are incompetent.
