  1. 1 Whether leave to file suit out of time for a case of malicious prosecution was properly granted.
  2. 2 Whether malicious prosecution was available with acquittal under Section 202 of the Criminal Procedure Code.
  3. 3 Whether the trial court misdirected itself in awarding general and special damages.

Ratio Decidendi

The High Court held that the Limitation of Actions Act does not permit extension of time for claims of malicious prosecution, as such extension is limited to torts of negligence involving personal injuries. The 1st respondent's reason for delay—lack of funds—did not meet the statutory requirements for extension. Furthermore, once the claim against the state was time-barred, the suit could not survive against the complainant (appellant). The trial court erred in granting leave and in awarding damages without proper legal basis or evidence of malice. The appeal was allowed, the lower court's judgment set aside, and the suit dismissed as unmerited and time-barred.
