Ratio Decidendi

While the applicant, as an aggrieved party, may have locus standi to seek review of a judgment under section 80 of the Civil Procedure Act and order 45 of the Civil Procedure Rules, the application must be filed in the suit whose judgment is sought to be reviewed. Filing a miscellaneous application is procedurally improper. The applicant was previously a party in ELC 82 of 2014 but withdrew and filed a separate suit, ELC 79 of 2017, and now seeks to benefit from a favorable judgment in the latter. The court cannot grant orders that are incapable of implementation due to procedural defects. The application is therefore struck out for being improperly before the court, without consideration...
