Ratio Decidendi

The court held that under Section 35 of the Law of Succession Act, a widow is only entitled to a life interest in the residue of the estate, not absolute ownership. The ultimate beneficiaries of the estate are the children of the deceased, and the widow holds the property in trust for them until they reach the age of majority. The proposal to have the entire estate devolve absolutely upon the widow was found to be contrary to the law. The grant was confirmed on the condition that the estate devolves upon the children in equal shares, to be held in trust by the widow, who enjoys a life interest subject to statutory limitations.
