The property had already been transferred to the respondent and the applicants had already been evicted. Any issues regarding the manner of eviction or alleged abuse of court process could be compensated by way of damages. Therefore, the intended appeal would not be rendered nugatory by refusal of stay. The application for stay of execution and injunction was therefore dismissed for lack of merit.
