Ratio Decidendi

The court found that the applicant had filed multiple suits and applications over the same subject matter against the same parties, which offends the doctrine of res judicata as codified in Section 7 of the Civil Procedure Act. The court determined that the issues raised in the present application had already been directly and substantially in issue in previous suits between the same parties, litigating under the same title, and had been heard and finally determined by competent courts. As such, the present application was barred by res judicata, and there was no need to address the merits of the orders sought. The application was therefore dismissed with costs to the respondents.
