Procedural Posture

Civil Suit / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the court can grant a stay of execution of orders not appealed against.
  2. 2 Whether a negative order is capable of being stayed under Order 42 Rule 6 of the Civil Procedure Rules.
  3. 3 Whether the court can grant stay pending the filing and determination of an application for injunction or stay in the appellate court.

Ratio Decidendi

The court found that the only order appealed against was the ruling of 7/7/2016, which was a negative order refusing to grant stay, setting aside, joinder, and striking out for want of jurisdiction. Such a negative order does not require any positive action and is not capable of enforcement, and therefore cannot be stayed. The orders of 5/3/2015 and 9/10/2015, which the applicant sought to stay, were not the subject of any pending appeal. As a result, the application did not fall within the ambit of Order 42 Rule 6. The court further held that it had no jurisdiction to grant a stay pending the filing and determination of an application for injunction or stay in the appellate court....
