The Court found that the applicant had satisfied the requirements for the grant of stay of execution pending appeal, namely that the intended appeal was not frivolous and that, absent a stay, the appeal could be rendered nugatory. The Court also determined that the preservation of the suit properties and the proceeds of sale was necessary to protect the interests of both parties pending the outcome of the appeal.
