The Tribunal found that both parties presented valuation reports, but the landlord's comparables were more relevant as they were on the same street and of similar size to the suit premises. The Tribunal exercised its discretion to set the rent at Kshs. 60,000/= per month, exclusive of VAT and service charge, down from the landlord's proposed Kshs. 79,000/=, taking into account the market rate increase over the seven years since the tenant occupied the premises. The effective date for the increment was set as 1st January 2023, and the tenant was ordered to pay any arrears occasioned by the increment within three months.
