Furthermore, the Respondent did not accord the Claimant a fair hearing or follow the procedural requirements set out in Section 41 of the Employment Act. The court held that the termination was both substantively and procedurally unfair. The Claimant was therefore entitled to compensation equivalent to nine months' salary for unfair termination.
