Ratio Decidendi

The court found that the defendants had already filed a suit (HC ELC No. E127 of 2022) over the same subject matter and between the same parties prior to the filing of the instant suit. The plaintiff was aware of the earlier suit at the time of filing the present one. Section 6 of the Civil Procedure Act prohibits proceeding with a suit where the matter in issue is directly and substantially in issue in a previously instituted suit between the same parties. The court held that the present suit was therefore sub judice and its filing constituted an abuse of court process. The preliminary objection was merited, and the suit was struck out with costs to the defendants.
