Ratio Decidendi

The court found that the plaintiff lacked locus standi to maintain the suit after his name was removed from the grant of letters of administration, as he no longer had a legal interest in the estate of the deceased. The court also held that the suit was rendered moot by the consent in the consolidated matter (ELC No 251 of 2018), where the plaintiff withdrew all claims in exchange for Kshs 80,000,000. The court further noted that the plaintiff had not pleaded damages in the plaint, nor sought to amend the pleadings to include such a claim, and parties are bound by their pleadings. Consequently, there was no basis to continue the suit, and the application to strike out the plaint was allowed.
