The Tribunal found that the orders issued on October 11, 2019, allowing the Landlord to levy distress for rent arrears and evict the Tenant, were executed and the substratum of the dispute had been overtaken by events. The Tenant's application for review and setting aside of those orders was rendered academic, as execution had already taken place and the Tenant did not demonstrate any claim for damages for wrongful eviction. The Tribunal held that reopening the issues would serve no practical purpose and allowed the Landlord's Reference dated August 16, 2019.
