Ratio Decidendi

The High Court held that the UDA EDRC lacked jurisdiction to entertain the 3rd respondent's complaint once the party list had been forwarded to the IEBC and the appellant had been cleared and gazetted as the UDA candidate. The court found that, at that stage, any dispute should have been addressed to the IEBC Dispute Resolution Committee, not the party's internal mechanisms. Consequently, the PPDT erred in upholding the UDA EDRC's decision, as it was made without jurisdiction. The appeal was allowed on this ground, and the decisions of both the UDA EDRC and the PPDT were set aside.
