Procedural Posture

Application / Ruling on Summons for Revocation of Grant

  1. 1 Whether the grant of letters of administration should be revoked under section 76 of the Law of Succession Act.
  2. 2 Whether the grant was obtained fraudulently or through concealment of material facts.
  3. 3 Whether the objector is estopped from challenging the grant after benefiting from the estate.

Ratio Decidendi

The court found that the objector failed to demonstrate any fraud or concealment by the petitioners in obtaining the grant. The objector actively participated in the distribution of the estate, sanctioned the sale of the subject property, and received a share of the proceeds. As such, he is estopped from challenging the grant from which he benefited. The court held that none of the statutory grounds for revocation under section 76 of the Law of Succession Act were met. The application for revocation of grant was therefore dismissed with costs to the respondents.
