The interlocutory injunction granted by the lower court had the effect of determining the entire suit at an interim stage, which is improper. The court held that refusing to grant a stay would render the intended appeal nugatory, as the appellants would be evicted from the land before their appeal is heard. Accordingly, the court exercised its discretion to grant a stay of the lower court's order pending the hearing and determination of the appeal, subject to the appellants filing and serving the record of appeal within 60 days.
