Ratio Decidendi

The court determined that the claimant's cause of action for wrongful dismissal accrued on 25th November 2003, the date of his dismissal. Under Section 4(1) of the Limitation of Actions Act, actions founded on contract must be brought within six years from the date the cause of action accrues. The claimant filed the suit on 2nd July 2015, twelve years after the dismissal, which is six years beyond the statutory limitation period. The court found that it lacked jurisdiction to entertain the matter as it was statute barred, and proceeding further would amount to arrogating itself jurisdiction contrary to law.
