The court found that while the Civil Procedure Rules set out a clear process for the admission and listing of appeals for directions, the practical administration at the station involved the Deputy Registrar issuing notices after receipt of the file and proceedings. In this case, the record of appeal had been duly filed and all parties were already informed of the appeal's status. The court held that sending the file back to the Deputy Registrar for further notices would serve no substantive purpose and would only delay the matter. Guided by Article 159 of the Constitution, the court determined that no prejudice would be occasioned to the respondents by issuing directions at this stage....
