The court found that the plaintiff, by holding the original deed plan number 316692, had established a prima facie case with a probability of success. The existence of two identical deed plans for the same property raised serious questions that could only be resolved at trial. The risk that the 2nd defendant might deal with the property in a manner prejudicial to the plaintiff, including transfer to third parties, constituted a real possibility of irreparable harm. The balance of convenience therefore required preservation of the suit property pending full hearing. Accordingly, the court granted the interlocutory injunction as prayed.
