Ratio Decidendi

The High Court found that the trial court failed to comply with the mandatory procedure for plea taking as required by section 207 of the Criminal Procedure Code and the principles in Adan v R. The language of the court was not indicated, the charge was not properly explained, and no unequivocal plea of guilty was entered or recorded. Furthermore, the sentence imposed exceeded the statutory maximum provided under section 20 of the Children Act. As a result, both the conviction and sentence were set aside, and the appellant was ordered to be released unless otherwise lawfully held.
