Upon re-evaluating the evidence and submissions, the appellate court found that the appellant failed to prove on a balance of probabilities that she was a passenger in the subject motor vehicle at the time of the accident. There were material contradictions between her oral testimony and documentary evidence, including inconsistencies regarding the hospital attended and the timing of the police report and issuance of the police abstract. The absence of her name in the Occurrence Book and lack of explanation for the delay in reporting further undermined her case.
