The Court of Appeal held that upon expiry of the lease on 31st March 2001, the appellant's continued occupation of the suit premises without the respondent's consent rendered it a trespasser under the Trespass Act, Cap. 294. The respondent was entitled to recover rent arrears for the period the lease was in force and mesne profits for the period of unlawful occupation thereafter. The erroneous reference to post-expiry payments as 'rent' did not alter the appellant's status as a trespasser or the respondent's entitlement to compensation by way of mesne profits.
