Ratio Decidendi

The court found that the Kenya Bridge Association is an unincorporated body exempt from registration and not established under any statute, and therefore lacks legal personality to sue or be sued in its own name. The applicants, as officials, had obtained authority from other members to bring the suit. Having satisfied the statutory requirements under the Civil Procedure Rules, the court granted the application for leave to bring a representative suit, as sought in prayers 2, 3, and 4 of the Notice of Motion dated 19th December 2006.
