Legal Issues
- 1 Whether the sentences imposed on the applicant for the four traffic offences were proper and legal.
- 2 Whether there is any basis for the High Court to interfere with the sentences imposed by the trial court.
Ratio Decidendi
The court found that the sentences imposed on the applicant for the four counts—causing obstruction, failing to wear prescribed clothing, driving without a badge, and failing to display a photograph—were all within the statutory limits set by the Traffic Act and Traffic Rules. The fines imposed did not exceed the maximums prescribed, and the minimums were observed where applicable. There was no evidence of illegality, impropriety, or error in the sentencing process. Consequently, the court held that there was no justification for interfering with the sentences imposed by the trial court and declined to grant any orders for revision.
