Procedural Posture

Employment Cause / Ruling on Motion to Declare Suit Compromised

  1. 1 Whether the suit has been compromised by the conduct of the claimant and subsequent events.
  2. 2 Whether the substratum of the claim remains after the disciplinary process and termination.
  3. 3 Whether the court should proceed to hear a matter overtaken by events.

Ratio Decidendi

The court found that the claimant's suit was based on his suspension and the disciplinary process. After the court declined to interfere with the process, the disciplinary proceedings were concluded, resulting in the termination of the claimant's employment and payment of terminal dues. The claimant did not amend his pleadings to reflect these developments. As such, the substratum of the claim was fundamentally altered and the issues raised became moot. The court held that proceeding with the matter would be an academic exercise, as the reliefs sought were no longer available or relevant. Therefore, the suit was struck out as having been overtaken by events.
