  1. 1 Whether the High Court has jurisdiction to vary a sentence passed by another High Court judge.
  2. 2 Whether the mandatory death sentence for murder is unconstitutional following the Supreme Court decision in Muruatetu.
  3. 3 Whether the commutation of a death sentence to life imprisonment by the President can be interfered with by the Judiciary.

Ratio Decidendi

The High Court lacks jurisdiction to vary or review a sentence passed by another High Court judge, as its supervisory powers do not extend to itself but only to subordinate courts and bodies. The applicant's sentence, though originally imposed under a mandatory regime later declared unconstitutional, was commuted to life imprisonment by the President, an act within the exclusive domain of the Executive. The Judiciary cannot interfere with such executive commutation. Therefore, the petition seeking downward variation of the sentence is without merit and must be dismissed for want of jurisdiction and legal basis.
