The claimant was not served with a dismissal letter prior to 1st December 2014 and was denied access to his workplace without being subjected to any disciplinary process or hearing. The court held that the claimant was constructively and unfairly dismissed, and that due process under the Employment Act was not followed. The claimant was therefore entitled to withheld salary up to the date of termination, compensation for unfair termination, and payment for unutilised leave. The respondent was also ordered to pay costs and interest.
