Since the previous suit was struck out on a preliminary objection and not discontinued or withdrawn, the applicant could not rely on Order 25 Rule 4 to seek a stay of proceedings in the subsequent suit. The applicant had other legal avenues to recover the taxed costs and could not use the stay of proceedings as a substitute for execution. The application for stay was therefore dismissed as lacking merit.
