Ratio Decidendi

The court found that the claimant's own pleadings and statements established that his employment was terminated in January 2010 when he was told not to report to work. The court rejected the claimant's argument that he was still awaiting formal recall, holding that the cause of action arose in January 2010. Applying Section 90 of the Employment Act, the court held that the claim should have been filed within three years from that date, i.e., by January 2013. Since the claim was filed on 9th July 2013, it was outside the statutory limitation period. The court therefore upheld the preliminary objection and dismissed the claim as time barred.
