Ratio Decidendi

The court found that although there was a delay of more than three months in filing the application for stay, this delay was excused because the claimants had not taken any steps towards execution of the decree. The court further held that substantial loss would result if stay was not granted, as the applicants contended that the claimants would be unable to refund the decreed sum if the appeal succeeded, and this was not contested by the claimants. Given the lack of opposition and absence of any demand for security by the claimants, the court declined to order the deposit of security. Consequently, the application for stay of execution pending appeal was allowed with no order as to costs.
