Miscellaneous Application / Ruling on Purchaser's Application for Confirmation of Sale

  1. 1 Whether the court should confirm the sale of land parcel Lietego Settlement Scheme/83 to the applicant following a public auction.
  2. 2 Whether any valid application to set aside the sale or stay execution had been made and determined in accordance with the Civil Procedure Rules.

Ratio Decidendi

The court found that the plaintiff/judgment debtor had made multiple unsuccessful applications to set aside the sale, stay execution, or review the judgment, all of which had been dismissed. No valid application remained pending under the relevant Civil Procedure Rules. Consequently, under Order XXI Rule 81(1), the sale by public auction became absolute, and the court was obliged to confirm the sale and issue a certificate to the purchaser. The applicant, having been declared the highest bidder and with no successful challenge to the sale, was entitled to confirmation of the sale and a certificate of sale. The court allowed the application and awarded costs to the purchaser/applicant.
