Procedural Posture

Stay Application / Ruling on Application for Stay of Execution and Payment by Instalments

  1. 1 Whether the application for stay of execution and payment of the decretal sum by instalments is res judicata.
  2. 2 Whether the court is functus officio in respect of the orders sought.
  3. 3 Whether the applicant has demonstrated sufficient cause to warrant payment of the decretal sum by instalments.

Ratio Decidendi

The court found that although a previous application for stay of execution had been determined, the specific issue of payment of the decretal sum by instalments had not been addressed in the earlier ruling. Therefore, the application was not res judicata nor was the court functus officio on this issue. The court acknowledged the applicant's financial hardship due to the closure of his business as a result of the COVID-19 pandemic but also considered the need for expeditious satisfaction of the decree. Exercising its discretion under Order 21 Rule 12 of the Civil Procedure Rules, the court granted a conditional stay of execution, requiring the applicant to pay half of the decretal sum...

Court Disposition

Application partly allowed with conditions.

Orders

  • Stay of execution granted on condition that half the decretal sum is paid within 90 days.
  • The balance of the decretal sum to be paid in equal monthly instalments of Kshs. 30,000 until payment in full.
