Procedural Posture

Judicial Review Application / Ruling on Application for Reinstatement

  1. 1 Whether the application previously struck out due to e-filing errors should be reinstated.
  2. 2 Whether payment of filing fees without proper document upload constitutes valid filing.
  3. 3 Whether technological errors in the Judiciary's e-filing system justify reinstatement of a suit.

Ratio Decidendi

The court held that while the payment of filing fees is necessary, it does not relieve a party of the responsibility to ensure that all required documents are properly uploaded to the e-filing portal. However, recognizing the infancy of the e-filing system and the potential for technological errors, as well as the financial hardship that could result from requiring the applicant to pay fees again, the court found it just to reinstate the suit. The applicant was directed to provide a complete set of pleadings by email to the Deputy Registrar within seven days, and the matter was set down for hearing. No order as to costs was made for the present application.

Court Disposition

Application allowed; suit reinstated for hearing.
